Terms of Service

Welcome to e-Samhita. These Terms of Service ("Terms") govern your use of the e-Samhita pharmacy management software and services ("Service"), provided by Mayur Kharat ("I," "me," or "my").
1. Acceptance of Terms
By creating an account, accessing, or using my Service, you agree to be bound by these Terms and my Privacy Policy. If you do not agree to these Terms, you may not use the Service.
2. Description of Service
e-Samhita provides a cloud-based pharmacy management software that includes features for inventory management, order management, supplier management, billing, invoicing, and reporting. The Service is intended for professional use by pharmacies.
3. User Accounts
To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account. You must be a registered pharmacy or a qualified professional operating under Indian law to create an account.
4. Subscriptions and Payment
a. Free Trial
I offer a 15-day free trial for new users. A nominal, non-refundable verification fee of ₹1 (one Indian Rupee) is required to start the trial to ensure the authenticity of the user account. During the trial period, you will have full access to all features of the Service. At the end of the trial, your access to most features will be disabled unless you purchase a paid subscription. I will send a notification to your registered email address 2 days before your trial ends.
b. Monthly Subscription
The monthly subscription fee is ₹500 (Indian Rupees). This is an advance payment for one month of service. The plan will automatically renew unless cancelled. I will send a payment reminder 7 days before your monthly subscription is due for renewal.
c. Annual Subscription
The annual subscription fee is ₹5000 (Indian Rupees), which is equivalent to paying for 10 months. This is an advance payment for one year of service.
d. Payments
All payments are non-refundable. All fees are exclusive of applicable taxes, including Goods and Services Tax (GST), which will be charged as per Indian law.
5. Data Privacy and Confidentiality
I am committed to protecting your data. I will handle your information, including any personal data and sensitive personal data, in accordance with my Privacy Policy and applicable Indian laws, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and the Digital Personal Data Protection Act, 2023. You retain all ownership rights to the data you upload to the Service.
6. User Responsibilities
You agree not to misuse the Service. You are responsible for complying with all applicable laws and regulations related to your pharmacy operations, including the Drugs and Cosmetics Act, 1940, and the Pharmacy Act, 1948.
7. Termination
I may terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
8. Limitation of Liability
To the maximum extent permitted by Indian law, Mayur Kharat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.
9. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.
